Research in Motion leads US stocks lower

NEW YORK: US stocks finished lower Thursday, with BlackBerry maker Research in Motion losing 5.8 per cent after launching a new operating system and Dow Chemical sagging nearly 7 per cent on a quarterly loss.

The Dow Jones Industrial Average finished down 49.84 points (0.36 per cent) to 13,860.58.

The broad-based S&P 500 dropped 3.85 points (0.26 per cent) to 1,498.11.

The tech-heavy Nasdaq Composite slipped 0.18 (0.01 per cent) to 3,142.13.

Facebook, which reported disappointing earnings after the close Wednesday, pulled back from an early sharp fall to end down just 1.1 per cent.

The Justice Department's filing of a suit to block the US$20 billion takeover of Mexican brewer Grupo Modelo by the world's largest beer group, Anheuser-Busch InBev, sent their shares tumbling.

US anti-trust authorities said the merger would give ABI control of nearly 50 per cent of the US beer market.

ABI shares lost 5.9 per cent, and on Mexico's Bolsa, Grupo Modelo lost 6.7 per cent.

The biggest casualty of the Justice Department's move was Constellation Brands, which was expected to gain control of the US importer of Modelo products -- which include Corona -- in the deal.

Constellation shares finished down 17.4 per cent.

Other companies reporting earnings whose shares fell included ConocoPhillips (-5.1 per cent) and Time Warner Cable (-11.3 per cent).

Among key gainers, chipmaker Qualcomm's shares added 3.9 per cent after several brokers gave it an upgrade following its strong quarterly results.

Casino operators Las Vegas Sands added 7.2 per cent after beating revenue growth forecasts helped by a new China operation, despite missing expectations on the bottom line. -- AFP

Amid stubborn resistance from Senate Republicans, former Sen. Chuck Hagel, R-Neb., launched a strong defense of both his values and his record during his defense secretary confirmation hearing before the Senate Armed Services Committee today, arguing that despite some controversial former positions on Israel, Iran, and gay rights, "no one individual vote, no one individual quote, no one individual statement defines me, my beliefs, or my record."

Hagel, who must gain the support of a majority of the 26 members of the committee in order to face a full Senate confirmation vote, pledged his commitment President Obama's positions on "all issues of national security, specifically decisions that the Department of Defense is in the process of implementing now."

"Our nation's security is the highest priority of our leaders and our government," Hagel said in his opening remarks. "We cannot allow the work of confronting the great threats we face today to be held hostage to partisanship on either side of the aisle."

Hagel's nomination has been controversial from the get-go: Of particular concern to Republicans and many Democrats is his past opposition of some sanctions for Iran; for his having taken stances on Hezbollah and Hamas that critics have decried as overly lenient; and for criticism of what he called "the Jewish lobby," which invoked the ire of pro-Israel advocates. Additionally, Hagel came out as a vocal critic of former President George W. Bush's policies in Iraq.

Democrats, meanwhile, have had their own, added gripes with the pick: In addition to being a Republican, Hagel was targeted for making anti-gay comments about an ambassadorial nominee in 1998, whose nomination he opposed for being "openly, aggressively gay." He also voted on multiple occasions to limit abortion access for American servicewomen abroad.

Despite the ongoing controversy surrounding his record, Hagel today expressed pride in it -- not because, he said, "of any accomplishments I may have achieved, or certainly because of an absence of mistakes, but rather because I've tried to build that record based on living my life and fulfilling my responsibilities as honestly as I knew how and with hard work."

"My overall worldview has never changed: That America has and must maintain the strongest military in the world; that we must lead the international community to confront threats and challenges together; and that we must use all tools of American power to protect our citizens and our interests," he said.

Republicans were less charitable in their characterization of Hagel's record.

Sen. James Inhofe, R-Okla., the top Republican on the Armed Services Committee, called it "deeply troubling and out of the mainstream." Of Hagel's worldview, Inhofe said it was "predicated on appeasing our adversaries while shunning our friends."

Hagel, McCain tussle over Iraq surge

Sen. John McCain, R-Ariz., a onetime friend of Hagel's who has not committed to vote for him, went after the former senator for his past opposition to the surge in Iraq, and asked him repeatedly whether or not his past assessment was a mistake.

"I'm not going to give you a yes or no answer," Hagel said, when pressed over whether he still believes the surge was, as McCain quoted him having once said, "the greatest foreign policy blunder since the Vietnam War." He said he thought the issue was more complicated than could be expressed in a one-word answer, and later explained his reasons for opposing the surge. He said he still wasn't sure whether or not it was necessary.

"I always ask the question is this going to be worth the sacrifice? Because there will be sacrifice," Hagel said. 

McCain, in contrast, essentially argued that the surge has been proven categorically and historically effective.

"I think history has already made a judgment about the surge and you're on the wrong side of it," McCain argued.

Even the committee's chairman, Sen. Carl Levin, D-Mich., said he and his colleagues would be interested in hearing Hagel's explanation of "troubling statements" he has made on a handful of foreign policy issues.

"There's much to be explored at this hearing," Levin said.

But Levin also signaled hedged support for Hagel's nomination, on the grounds that Mr. Obama "needs to have a Secretary of Defense in whom he has trust, who will give him unvarnished advice, a person of integrity and one who has a personal understanding of the consequences of decisions relative to the use of military force."

Hagel's confirmation is not a sure bet, but the numbers, for the time being, are on his side. Most Democratic senators appear to have ironed out their issues with the candidate in private, one-on-one meetings, and barring a congressional hold or a filibuster, he can squeak through the confirmation process without the support of his fellow Republicans.

Still, Hagel has virtually no margin of error in his path to confirmation: While no Democrats are promising to vote against him, a number have not pledged to vote in his favor, either. And so far, only one Republican, Sen. Thad Cochran of Mississippi, has said he will vote in favor of the president's pick, according to MSNBC.

In his opening remarks today, Hagel attempted to alleviate concerns about his controversial past statements, strongly emphasizing his commitment to preventing a nuclear Iran, and promising to stay supportive of "our friend and ally Israel."

"I am fully committed to the president's goal of preventing Iran from obtaining a nuclear weapon, and - as I've said in the past - all options must be on the table to achieve that goal," he said. "My policy is one of prevention, and not one of containment - and the President has made clear that is the policy of our government. As Secretary of Defense, I will make sure the Department is prepared for any contingency."

Child believed unharmed as Ala. hostage ordeal drags on - Detroit Free Press

MIDLAND CITY, Ala. - A hostage standoff continued into the third day Thursday in rural Alabama where a man who kidnapped a 5-year-old boy from a school bus after killing the driver kept the child hostage in an underground bunker at his home, which was surrounded by police and SWAT teams.

Asked how long the standoff would last, Dale County Sheriff Wally Olson told reporters early Thursday, "We have no way of knowing that right now."

Dale County authorities said the child appeared to be on good condition, despite the ordeal.

"We have no reason to believe that the child has been harmed," Olson said.

State Rep. Steve Clouse, who met with authorities and visited the boy's family, said that the bunker had food and electricity, and that the boy was watching TV.

Authorities communicated with the suspect through a PVC pipe connected to the bunker, WSFA-TV reported, and were also able to pass some unidentified medicine for the boy.

Local residents attended vigils at several churches Wednesday night, lighting candles and praying for the boy's safe release, according to WSFA-TV.

A law enforcement official who is not authorized to speak to the media identified the man as Jimmy Lee Dykes, 65, a retired truck driver and Navy veteran.

"As far as we know there is no relation at all (between Dykes and the hostage). He just wanted a child for a hostage situation," said Michael Senn, a pastor who helped comfort traumatized children after the attack.

Sheriff's deputies had arrested Dykes on Dec. 22 and charged him with menacing for a Dec. 10 complaint, court records show. He spent four days in jail before posting the $500 bail.

His trial was to have begun Wednesday at 9 a.m.

Instead, he is accused of grabbing a 5-year-old boy off a school bus Tuesday afternoon after killing the 66-year-old bus driver, Charles Poland, who had tried to block access to the vehicle.

Patricia Smith, a neighbor whose two children were on the bus, said the gunman shot Poland four times and fled with the 5-year-old. The suspect then took the boy to a homemade bunker that he had apparently been constructing for years on his nearby property.

Authorities said Dykes lives in a small trailer at the end of a red dirt road, but they gave few details about the hostage standoff or whether Dykes had made any demands.

The Dale County Sheriff's Office reports Dykes is connected to the anti-government survivalist movement.

In an interview Wednesday with The Dothan Eagle, the bus driver's wife, wife, Jan Poland, recalled their ritual of sitting in their enclosed porch after he returned from driving, having coffee and watching the sun set or listening to the rain.

She said their favorite Bible verse was 2 Timothy 1:12, which she recited with their daughter, Lydia:

"For the which cause I also suffer these things: nevertheless I am not ashamed: for I know whom I have believed, and am persuaded that He is able to keep that which I have committed unto Him against that day."

"That is what I hold onto right now." she said, clutching her daughter's hand. "God knows. He is the one who is going to have to bring closure to my heart."

Terry Howard, the interim pastor at First Assembly of God in Newton, Ala., described Poland as "a good guy" who "loved to help people."

Protecting the children "would be in his nature," he said, noting that Poland's wife is a substitute teacher.

Authorities communicated with the suspect through a PVC pipe connected to the bunker, WSFA-TV reported, and were also able to pass some unidentified medicine for the boy.

Neighbors said Dykes had lived for about a year at the residence in Midland City, population 2,300. Before that he spent time in Texas and in Panama City, Fla., The Dothan Eagle reported.

Florida Department of Law Enforcement records show he was arrested in Panama City in February 1995 and charged with improper exhibition of dangerous weapons or firearms, a misdemeanor. The charge was dismissed four months later.

The Southern Poverty Law Center's Hatewatch, which tracks radical hate groups, said Tim Byrd, chief investigator with the Dale County Sheriff's Office, described Dykes as having "anti-America" views and ties with the anti-government "survivalist" movement.

"His friends and his neighbors stated that he did not trust the government, that he was a Vietnam vet, and that he had PTSD," Byrd said, according to Hatewatch. "He was standoffish, didn't socialize or have any contact with anybody. He was a survivalist type."

Michael Creel, who lives nearby, told The Eagle that Dykes' bunker, similar to those used against tornadoes, was 4 feet wide, 6 feet long and about 8 feet deep, covered in sand.

Neighbor Mike Smith said Dykes once threatened to shoot his children when the family's dogs entered his property.

Neighbor Ronda Wilbur said Dykes was known to go out in the middle of the night to shoot birds and rabbits. She said Dykes had cut down nearly all the trees on his lot, erected a wire fence and "would go berserk" if a dog strayed onto his land.

She said her dog died of injuries after Dykes beat it with a lead pipe.

Puncak Semangat buys 10pc China Auto

Puncak Semangat Sdn Bhd, believed to be linked to tycoon Tan Sri Syed Mokhtar Al Bukhary, is said to have bought shares in China Automobile Parts Holdings Ltd, resulting in the company owning more than 10 per cent stake in the automotive chassis components manufacturer.

"The private equity firm bought the shares of the just-listed Fujian Province-based company via the open market," said a source who requested to remain anonymous.

Asked for the rationale behind the acquisition, the source said:"At this point of time, it is unclear whether Puncak Semangat purchased the stake for investment or synergy purposes."

Syed Mokhtar, is no stranger to the automotive industry as he
owns the country's biggest automotive company, DRB-Hicom Bhd. DRB-Hicom is one of the major players in the automotive industry in Malaysia, being involved in the entire integrated chain of the automotive ecosystem such as manufacturing and supply of automotive components, assembly, distribution and sales of motorcycles and commercial vehicles, as well as, the distribution and sales of passenger cars.


China Automobile, meanwhile, makes replacement parts for commercial vehicles, particularly trucks, out of its sole production centre in the Fujian province.

The company is a specialist in manufacturing chassis components used in vehicles for transporting goods.

It sells five categories of products namely wheel-hub bolts, wheel axles, steel pins, u-bolts and torque-rod bushings.

Currently, the source said the company, which has seven patents registered in China, has no direct competitor in that country.

Its product lines are also supplied for after-market repair, maintenance and modification, with an emphasis towards catering for components used in heavy vehicles.

Demand for these after-market parts are driven by the need to periodically replace such parts, which endure significant wear and tear over the operating life span of goods-transporting vehicles, the source said.

Additionally, vehicles modified to carry heavier loads require reinforcement of its rear suspension system, which involve replacing existing parts with stronger models capable of enduring higher stress, he said.

At present, 65 per cent of its sales are derived from China while the rest comes from Southeast Asia and the Middle East.

Yesterday, China Automobile, Malaysia's first initial public offering (IPO) of the year, was the top gainer and most active counter.

Its share price surged 44 sen to RM1.12 before settling the trading day at 78 sen, up 10 sen from its IPO price of 68 sen, with 192 million shares exchanging hands. -- Bernama

Banks drop on short-term credit cut

Shares of CIMB Group Holdings Bhd, Hong Leong Bank Bhd, Malayan Banking Bhd (Maybank), Public Bank Bhd and RHB Capital Bhd dropped after Moody's Investors Service cut the Malaysian lenders' short-term credit ratings on Thursday.

Moody's downgraded eight A3 rated Malaysian banks' short-term ratings to "Prime-2" from "Prime-1" to reflect the rating house's observations of the transition risks of short-term ratings that these lenders represent over time.

"Key determinant for assigning a short-term rating is an issuer's long-term risk of default," Moody's said in a research note.

"Moody's believes that, other things being broadly equal, lower long-term ratings imply not only increased default risk for long-term obligations but also increased default risk for short-term obligations," it added.

CIMB Group dropped 0.14 per cent to RM7.21 per share, Hong Leong was down 0.14 per cent to RM14.14, Maybank skidded 0.22 per cent to RM8.88, Public Bank fell 0.13 per cent to RM15.50 and RHB Capital dropped 0.13 per cent to RM7.73. -- Reuters

Giffords: "Too many children are dying"

In remarks kicking off today's Senate Judiciary Committee hearing on gun violence, former Rep. Gabrielle Giffords, D-Ariz., made a defiant call for Congress to "be bold" and "act" on gun violence.

"Too many children are dying," she said. "We must do something."

Giffords, who survived a gunshot to the head two years ago during an assassination attempt that left six people dead, read slowly but forcefully from prepared remarks, and acknowledged that "speaking is difficult."

"But I need to say something important. Violence is a big problem," she said. "It will be hard. But the time is now. You must act. Be bold. Be courageous. Americans are counting on you."

The longstanding debate over the nation's gun laws has taken on renewed resonance in recent weeks, in the aftermath of a mass shooting last month that left 20 first-graders and six adult faculty members dead at a small-town elementary school in Newtown, Conn.

Since then, Mr. Obama and Vice President Joe Biden have vowed to enact meaningful change to reduce gun violence in America, and consulted stakeholders from all sides of the debate on how best to achieve that goal. In remarks unveiling his findings from that process earlier this month, Mr. Obama proposed a series of sweeping new laws, including the reinstatement of the assault weapons ban, universal background checks on gun buyers, and a ban on high-capacity magazine ammunition.

Today's congressional hearing marks the first on gun control since President Obama's proposals, and the Senate Judiciary Committee's first legislative hearing in the new Congress.

Mark Kelly: With gun rights come responsibilities

Testifying before the committee this morning, former astronaut Mark Kelly, Giffords' husband, made an impassioned entreaty for bipartisan action to curb gun violence. Kelly, who with Giffords recently started a PAC with that same goal, said his first priority is fixing the nation's background check system.

"The holes and our laws make a mockery of the background check system. Congress should close the private sales loophole, and the dangers people entered into that system," he said.

Kelly: Stronger background check would have stopped Tucson shooter

Kelly also called for tougher gun trafficking laws, the removal of limitations on collecting data and scientific research on gun violence, and "a careful and civil conversation about the lethality of fire arms we permit to be legally bought and sold in this country."

He stressed that both he and Giffords are gun owners, and that they support the "right to own a firearm for protection, collection and recreation."

"Gabby and I are pro-gun ownership. But we are also anti-gun violence," he said. "When dangerous people get dangerous guns, we are all the more vulnerable."

The implementation of universal background checks is thought to be among the White House's top priorities with regard to its gun control proposals, and James Johnson, chief of police for Baltimore County, Md., and chairman of the National Law Enforcement Partnership to Prevent Gun Violence, supported the notion of its efficacy.

"The best way to stop a bad guy from getting a gun in the first place is a good background check," Johnson said.

Johnson also said he's seen an "explosion of fire power since the assault weapons ban expired," and argued that "the ban on assault weapons, and high-capacity ammunition must be reinstated."

"Victims are being riddled with multiple gunshots," he said. "The common-sense measures we call for will not infringe on the Second Amendment rights, but will keep guns out of the dangerous hands of -- of people who are out there to commit danger in our society, and excessive firepower out of our communities."

While gun control advocates and many Democrats have applauded the White House for recent action on this issue, it's unclear which of these proposals -- if any -- can make it through the Republican-controlled House of Representatives. And the pro-gun lobby has already begun using its considerable resources to target the president's proposals.

NRA CEO: "Be honest about what works" on gun violence

Wayne LaPierre, the CEO and Executive Vice President of the NRA, made the case this morning that efforts to curb gun violence should be focused strengthening school security and mental health resources. He also stated his opposition to closing gun show loopholes, arguing that criminals won't submit to background checks anyway. 

"The problem with gun laws is, criminals don't cooperate with them. The mentally ill don't cooperate with them," he said. "Law-abiding gun owners will not accept blame for the acts of violent or deranged criminals, nor do we believe the government should dictate what we can lawfully own and use to protect our families... We need to be honest about what works and what does not work. Proposals that would only serve to burden the law-abiding have failed in the past and will fail in the future."

Gayle Trotter, an attorney and senior fellow at the Independent Women's Forum, also argued that assault weapons provide a woman with "peace of mind" -- because "knowing she has a scary looking gun gives her more courage."

"An assault weapon in the hands of a young woman defending her babies at her home becomes a defense weapon," she said.

Nicholas Johnson, a law professor at Fordham University School of Law, also appeared as a witness at the hearing.

GDP unexpectedly shrinks, decline seen temporary - Reuters

(Reuters) - The economy unexpectedly contracted in the fourth quarter, suffering its first decline since the recession ended more than three years ago as businesses scaled back on restocking and government spending plunged.

Gross domestic product fell at a 0.1 percent annual rate after growing at a 3.1 percent clip in the third quarter, the Commerce Department said on Wednesday.

That was the worst performance since the second quarter of 2009 and showed the economy entering the new year with little momentum. Economists polled by Reuters had expected GDP to rise at a 1.1 percent rate and none had predicted a contraction.

But economists said there was no reason for panic.

Inventories and government spending sliced 2.6 percentage points from growth, a weight that was expected to lessen in the first three months of the year.

At the same time, consumer spending accelerated and business investment rebounded, suggesting some fundamental strength that should help to support the recovery even as Washington tightens its belt.

"We are not concerned that the economy is slipping back into recession," said John Ryding, chief economist at RDQ Economics in New York.

A second report showed private employers stepped up hiring in January, suggesting an improvement in the labor market. An increase in job gains could help the economy to weather the headwind of higher taxes and possible spending cuts this year.

The ADP National Employment Report showed private payrolls rose 192,000 in January after increasing 185,000 in December.

Stocks on Wall Street were mostly flat, while prices for U.S. Treasury debt fell and the dollar weakened against a basket of currencies.

The data was published as officials at the Federal Reserve wrap-up a two-day meeting. The report will likely provide ammunition for officials at the U.S. central bank to stay on their ultra-accommodative policy stance.

Economists say a growth pace in excess of 3 percent would be needed over a sustained period to significantly lower high unemployment. For the whole of 2012 the economy grew 2.2 percent, and a report on Friday is expected to show the jobless rate held at 7.8 percent for a third straight month in January.

INVENTORY DRAG

The economy was slammed by a monster storm in late October, which caused extensive damage along the East Coast. Economists said that could have cut around 0.5 percentage point off fourth-quarter growth.

The recovery also had to deal with uncertainty over the so-called fiscal cliff of scheduled tax hikes and budget cuts, which hurt confidence even though households and businesses seemed to largely shrug off the worries.

Businesses, caught with too much inventory in their warehouses in the third quarter, slowed their stock building in the final three months of the year.

That slowdown reduced GDP growth by 1.27 percentage points, the most in two years.

But with the pick-up in consumer spending in the fourth quarter, businesses now will need to replenish stocks, which should help lift growth early this year.

"The near stall in inventories and stronger durable spending suggest greater cyclical recovery momentum than expected," said Steven Wieting, an economist at Citigroup in New York.

Excluding inventories, the economy grew at a 1.1 percent rate, slowing from the third quarter's 2.4 percent.

Government spending tumbled at a 6.6 percent rate as defense outlays plunged at a 22.2 percent pace, wiping out the previous quarter's gains. The decline in defense spending was the largest since the third quarter of 1972.

Government subtracted 1.33 percentage points from growth. The likelihood of fresh spending cuts suggests government outlays will remain a drag on the economy, but not as big of a weight as in the fourth quarter.

Export weakness also cut into GDP. Exports have been hampered by a recession in Europe, a cooling Chinese economy and storm and strike-related port disruptions. Overall trade cut a quarter of a percentage point from the change in GDP. Exports fell for the first time since the first quarter of 2009.

RISING INCOME PROVIDES A BRIGHT SPOT

In one bright spot, the report showed that income available to households after taxes and inflation increased at a strong 6.8 percent rate in the fourth quarter.

In addition, the saving rate rose by more than a percentage point, which should cushion households against higher taxes.

Consumers were helped by an easing in inflation.

A price gauge in the report advanced at just a 1.2 percent pace, down from 1.6 percent in the third quarter. So-called core prices increase just 0.9 percent, the smallest gain in two years.

Consumer spending, which accounts for more than two-thirds of economic activity, rose at a 2.2 percent rate, accelerating from the prior quarter's 1.6 percent growth pace, while business investment rebounded after its first drop in 1-1/2 years.

The housing market was another positive.

Residential construction grew at a 15.3 percent rate after notching a 13.5 percent growth pace in the third quarter.

Homebuilding added to growth last year for the first time since 2005.

"A turnaround in the housing market will be a key support to the economy this year, with homebuilding contributing to growth and higher home prices supporting consumer spending," said Stuart Hoffman, chief economist at PNC Financial in Pittsburgh.

The ratings reflect HLA's established franchise in the life-insurance segment, the high persistency rate of its products, the Company's strong liquidity profile and its ability to leverage on the distribution network of Hong Leong Bank Berhad (rated AA1/stable/P1 by RAM). HLA is the insurance arm of the larger Hong Leong Financial Group Berhad, and derives strong financial flexibility from the latter. India, the world's No.1 edible oil buyer, this month hiked import duties on crude imports to 2.5 per cent from zero and lifted a six year freeze on the taxable value of cargoes to curb cheap imports from top palm suppliers Indonesia and Malaysia. While India left refined edible oil import duties unchanged, the policy move on crude showed it was still wary on inflation that slowed last month to its lowest in three years, said Mistry, who closely tracks the country's oilseed sector. "I expect the next step to be announced in the budget at the end of February," Mistry, head of trading with India's leading speciality chemicals group, Godrej Industries, told Reuters in an interview on Wednesday. "The industry has requested import duty at 10 per cent on unrefined oils and 17.5 per cent on refined oils and I believe we shall get that level by end of March 2013 at the latest," he said. New Delhi raising import taxes counters Malaysia's move to lower its crude export duty to reduce record palm oil stocks and helps to raise India's falling domestic oilseed price. As a rule of thumb, India's soybean and rapeseed farmers need a minimum price of 35,000-38,000 rupees (650-710) a tonne to continue planting these crops, Mistry said. Mistry said that any further policy move by India would impact these two Southeast Asian countries where palm oil prices were very high at RM2,400-RM2,500 (US$790-US$820) even though Malaysian stocks hit a record 2.6 million tonnes in December. Mistry said these prices may not prompt much expansion in demand for the edible oil as palm oil output grows and competing soyoil supply jumps from May onwards. "I do not expect Malaysian stocks to decline below 2 million tonnes in the foreseeable future," he said. Malaysia's January palm oil stocks will be almost unchanged from December, with declines expected in February to April. By May, stocks will build again, Mistry said. Indonesia, which does not publish stocks figures, has current inventories of about 5 million tonnes. Obama to pitch immigration reform - CNN

Washington (CNN) -- President Barack Obama heads to Las Vegas on Tuesday to make his pitch for an overhaul of the immigration system after failing to press the issue during his first four years in office.

With his re-election last November aided by strong support from Latino voters, Obama has made a comprehensive immigration bill a top legislative priority of his second term.

The president will highlight his immigration stance in a speech at 2:55 p.m. ET at Del Sol High School, which the White House says has a 54% Hispanic student body, according to U.S. News and World Report rankings.

Senior administration officials say Obama will not introduce new legislation on Tuesday, a day after eight senators unveiled a bipartisan framework for immigration reforms.

Obama came under criticism from Latino activists for failing to deliver on a 2008 campaign promise to make overhauling immigration policy a priority of his first term.

Last year, as his re-election campaign heated up, the Obama administration announced a halt to deportations of some young undocumented immigrants in a move that delighted the Latino community.

Exit polls in November indicated that Latino voters gave overwhelming support to Obama over GOP challenger Mitt Romney, who had advocated a policy that amounted to forcing undocumented immigrants to deport themselves.

On Tuesday, Obama will press for quick action on immigration and share details about his proposal, which includes a path to citizenship for more than 11 million undocumented immigrants.

The White House may consider introducing its own legislation if the Senate framework made public Monday fails to gain traction, according to the administration officials.

Under the compromise plan by the senators, millions of undocumented immigrants would get immediate but provisional status to live and work in the United States.

The senators' outline also called for strengthening border controls, improved monitoring of visitors and cracking down on hiring undocumented workers.

Only after those steps occurred could the undocumented immigrants already in the country begin the process of getting permanent residence -- green cards -- as a step toward citizenship, the senators said at a news conference.

Conservatives split on reform

Florida Sen. Marco Rubio, a tea party-backed conservative considered a rising star in the Republican Party, said the goal of the framework he helped put together was a "modern immigration system" that treated everyone fairly, both the undocumented and those waiting to come to America legally.

"None of this is possible if we don't address the reality there are 11 million people in this country who are undocumented," Rubio said Monday.

However, another tea party-backed Republican, Sen. Mike Lee of Utah, objected to the framework by his colleagues, saying the guidelines "contemplate a policy that will grant special benefits to undocumented immigrants based on their unlawful presence in the country."

Other conservatives immediately voiced their opposition to what they called amnesty, a code word on the political right for providing undocumented immigrants a path to legal status.

What's in Senate immigration plan?

"When you legalize those who are in the country illegally, it costs taxpayers millions of dollars, costs American workers thousands of jobs and encourages more illegal immigration," said Rep. Lamar Smith, R-Texas, who serves on the immigration subcommittee in the House. "By granting amnesty, the Senate proposal actually compounds the problem by encouraging more illegal immigration."

A litany of left-leaning advocacy groups spoke out on the senators' plan, praising it as a good first step but cautioning against harming the rights of workers.

"The people of this country are ready for us to be one country again without second-class people being mistreated simply because they lack paper, even though they are already contributing to our economy and our tax system," NAACP President Ben Jealous said.

Democratic senators backing the plan include Chuck Schumer of New York, Dick Durbin of Illinois, Robert Menendez of New Jersey and Michael Bennet of Colorado. On the Republican side were Rubio, John McCain of Arizona, Lindsey Graham of South Carolina and Jeff Flake of Arizona.

Durbin said Tuesday that immigration reform must have bipartisan support to work, so it won't include everything everyone wants.

"It's going to look different than what I might write, or the president might write," he said.

House works on own plan

A similar effort on immigration is said to be under way in the House, involving a group of Republicans and Democrats.

Two senior House Democratic sources briefed on the effort told CNN the group was working to release some sort of outline of its plan soon, possibly as early as this week, but concede "they are not as far along as the Senate."

Like the Senate framework, the House plan will include a path to citizenship, but details of how that will work are still being discussed.

The Senate proposal is a good starting point, Rep. Joe Garcia, D-Florida, said Tuesday on CNN.

65 found executed in Syria's Aleppo - The News International

BEIRUT: At least 65 people, apparently shot in the head, were found dead with their hands bound in a district of the northern Syrian city of Aleppo on Tuesday, activists said.

The British-based Syrian Observatory for Human Rights, which says it provides objective information about casualties on both sides of Syria's war from a network of monitors, said the death toll could rise as high as 80. It was not clear who had carried out the killings.

Opposition activists posted a video of a man filming at least 51 muddied male bodies alongside what they said was the Queiq River in the rebel-held Bustan al-Qasr neighborhood of Aleppo.

The bodies had gunshot wounds to their heads, and their hands were bound. Blood was seeping from their heads and some of them appeared to be young, possibly teenagers, and dressed in jeans, shirts and sneakers.

The Queiq River rises in Turkey and travels through government-held districts of Aleppo before it reaches Bustan al-Qasr.

"They were killed only because they are Muslims," said a bearded man in another video said to have been filmed in central Bustan al-Qasr after the bodies were removed from the river. A pickup truck with a pile of corpses was parked behind him.

It is hard for Reuters to verify such reports from inside Syria because of restrictions on independent media.

Government forces and rebels in Syria have both been accused by human rights groups of carrying out summary executions in the 22-month-old conflict, which has claimed more than 60,000 lives.

Rebels pushed into Aleppo, Syria's most populous city, over the summer, but are stuck in a stalemate with government forces. The city is divided roughly in half between the two sides.

The revolt started as a peaceful protest movement against more than four decades of rule by President Bashar al-Assad and his family, but turned into an armed rebellion after a government crackdown.

More than 700,000 people have fled, the United Nations says.

REBELS FIGHT KURDS

In the eastern city of Deir al-Zor, insurgents including al Qaeda-linked Islamist fighters captured a security agency after days of heavy fighting, according to an activist video issued on Tuesday.

The fighters freed prisoners from the building, it added.

The video, posted online, showed men armed with assault rifles cheering as they stood outside a building that they said was a local branch of Syria's intelligence agency.

Some of the fighters carried a black flag with the Islamic declaration of faith and the name of the al-Nusra Front, which has ties to al Qaeda in neighboring Iraq. The video also showed tanks, which appeared to be damaged, and a room containing weapons.

The war has become heavily sectarian, with rebels who mostly come from the Sunni Muslim majority fighting an army whose top generals are mostly from Assad's Alawite sect, an offshoot of Shi'ite Islam. Assad has framed the revolt as a foreign-backed conspiracy and blames the West and Sunni Gulf states.

Fighting also took place in the northern town of Ras al-Ain, on the border with Turkey, between rebels and Kurdish militants, the Observatory said.

The insurgents have been battling fighters of the Kurdish People's Defence Units for about two weeks in the area, and scores of people have died in the violence. (Reuters)

KL shares mixed at mid-morning

Share prices on Bursa Malaysia turned mixed at mid-morning today in sync with the performance of other regional bourses, dealers said.

At 11.12 am, the FTSE Bursa Malaysia KLCI (FBM KLCI) rose 2.31 points to 1,639.44, after opening 7.89 points higher at 1,645.02.

Regionally, Japan's Nikkei improved 68.63 points to 10,892.94, while Hong Kong's Hang Seng lost 22.05 points to 23,649.83 and Singapore's Straits Times slipped 0.24 of a point to 3,273.67.

On Bursa, the Finance Index chalked up 19.69 points to 14,904.08, the Plantation Index increased 11.77 points to 8,043.06, and the Industrial Index increased 20.61 points to 2,773.94.

The FBM Emas Index went up 10.02 points to 11,152.11, the FBMT100 was 12.01 points higher at 11,002.76, and the FBM Ace Index added 6.39 points to 4,128.37.

The FBM Mid 70 Index, however, lost 3.02 points to 12,152.02.

Losers led gainers by 313 to 184, with 271 counters unchanged, 889 untraded and 46 others suspended. Volume stood at 387.417 million shares worth RM499.414 million.

Among actives, Oriented Media Group and Daya Materials added half-a-sen each to 12 sen and 22 sen respectively, while Tebrau Teguh and Patimas lost half-a-sen each to 92.5 sen and 11 sen, respectively.

Of the heavyweights, Maybank earned two sen to RM8.92, Sime Darby gained seven sen to RM9.36 and CIMB rose six sen to RM7.27, but Axiata lost two sen to RM6.35. -- Bernama

US stocks fall despite upbeat factory data

NEW YORK: Stocks finished Monday mostly lower despite a stronger-than-expected manufactured durable goods report and a nearly 2 per cent lift from Caterpillar earnings.

At the close, the Dow Jones Industrial Average was down 14.05 points (0.10 per cent) to 13,881.93.

The broad-based S&P 500 fell 2.78 points (0.18 per cent) to 1,500.18.

The tech-heavy Nasdaq Composite Index rose 4.59 (0.15 per cent) to 3,154.30, boosted by Apple.

Orders for manufactured durable goods rose to US$230.7 billion, up 4.6 per cent from November, the Commerce Department said. Analysts had expected a rise of just 1.6 per cent.

But December pending home sales, which were projected to be flat, instead fell by 4.3 per cent.

Monday's lacklustre equity action came on the heels of rallies that have lifted stock indices to multi-year highs.

Slumping technology company Apple reversed recent losses and picked up 2.3 per cent, replacing ExxonMobil as the world's largest company by market capitalisation. ExxonMobil fell 0.7 per cent.

Yahoo!, which reported stronger-than-expected earnings after the market closed, fell 0.3 per cent, but jumped 4.5 per cent in after-hours trading.

Caterpillar gained 2 per cent after posting a big year-on-year drop in quarterly profit but suggesting business could pick up in the second half of 2013.

Energy company Hess surged 6.1 per cent after it announced it was selling refining and terminal operations in the United States and placing more focus on exploration and production.

Research in Motion, which will launch its newest BlackBerry smartphone this week, gave up 7.8 per cent.

Industrial coatings maker PPG lost 2.0 per cent after the closing of the share-exchange period related to the merger of its commodity chemicals business with Georgia Gulf Corp, to become the PPG spinoff Axiall. Georgia Gulf gained 8.6 per cent.

Menswear retailer Jos. A. Bank dived 15.1 per cent after warning that its fiscal 2012 profit was expected to be 20 per cent lower than the prior year, citing lower sales due to unseasonably warm winter weather. -- AFP
