Lynas' shares jump after Malaysian court win

SYDNEY: Shares in Australia's Lynas Corp jumped as much as 5.1 per cent on Tuesday after the company said a Malaysian court had dismissed a challenge by protesters against its long-delayed rare earth processing plant.

The $800 million rare earth plant - the world's biggest outside China - finally began production in November after lengthy environmental and safety disputes with local residents and the Save Malaysia Stop Lynas (SMSL) protest group since construction began two years ago.

Lynas said the Federal Court had dismissed an appeal by SMSL to seek a judicial review of the decision to grant it a temporary operating licence.

"SMSL has now exhausted all avenues of appeal in the Malaysian Courts with respect to this challenge," Lynas said in a statement late on Monday.

The plant in Kuantan is considered important to breaking China's grip on the processing of rare earths, which are used in products ranging from smartphones to hybrid cars.

Lynas shares rose to a high of A$0.615 and last traded up 4.3 per cent at A$0.61, half the level it was a year ago.-- Bernama

KL shares rebound in early trade

Share prices on Bursa Malaysia rebounded from its recent losses to open higher Tuesday on renewed buying interest, dealers said.

As at 9.19am, the FTSE Bursa Malaysia KLCI (FBM KLCI) was 0.94 of a point better at 1,622.3 after opening seven points higher at 1,621.43.

HwangDBS Vickers Research said local sentiment would still be clouded by prevailing weak external vibes.

"Last night, key US equity indices lost between 0.4 per cent and 0.6 per cent due to knock-on effects from Cyprus' proposal to tax bank depositors to boost the government's coffers.

"As such, the benchmark FBM KLCI, which hit a low of 1,613.94 before recovering to close at 1,621.36 yesterday, could remain under pressures today," it said in a note today.

The research house expected the key FBM KLCI to possibly retreat towards the immediate support line of 1,615.

HwangDBS noted stocks that are expected to come under the spotlight today included WCT Bhd, which has bagged a RM315 million contract to build commercial buildings in Putrajaya.

It also included oil and gas plays like Alam Maritim Resources Bhd and Perdana Petroleum Bhd, amid media reports saying that Petronas was set to award as many as 34 offshore support vessel contracts valued at an estimated RM3 billion over the next few weeks.

On the chart, the Finance Index chalked up 15.09 points to 15,160.16.

The Plantation Index, however, shed 0.69 of a point to 7,815.02 and the Industrial Index slipped 4.68 points to 2,812.04.

The FBM Emas Index earned 10.8 points to 11,104.35, the FBM Ace Index gained 10.69 points to 3,938.44, the FBMT100 was 10.32 points higher at 10,944.7 and the FBM Mid 70 Index increased 28.23 points to 12,356.75.

Gainers beat losers 96 to 60, with 127 counters unchanged, 1,357 untraded and 17 others were suspended.

Turnover stood at 38.444 million shares worth RM36.705 million.

Actives, Pasukhas Group and Fast Track Solution inched up half-a-sen each to 16 sen and nine sen, respectively, and Tebrau Teguh added three sen to RM1.24.

Heavyweights, Maybank rose two sen to RM9.06 while Petronas Chemicals and Maxis were flat at RM6.28 and RM6.50, respectively.

However, Sime Darby lost four sen to RM9.12, Axiata Group was one sen lower at RM6.30 and CIMB Group eased two sen to RM7.04.-- Bernama

Resistance in Cyprus Grows to Europe's Bailout Plan - New York Times

NICOSIA, Cyprus — Leaders in Cyprus and Brussels scrambled Monday to contain the fallout from an unprecedented effort to force ordinary bank depositors in this crisis-hit nation to pay for part of an international bailout, as stock markets faltered on concerns about the wider implications for Europe's long-running debt crisis.

President Nicos Anastasiades was trying to compel policy makers in Brussels to soften demands for a tax to be assessed on Cypriot bank deposits, saying European Union leaders used "blackmail" to get him to agree to those conditions early Saturday in order to receive a bailout package worth 10 billion euros, or $13 billion.

Cyprus, whose banking system is verging on collapse, is now the fifth nation in the 17-member euro union to seek financial assistance since the crisis broke out three years ago.

As anger in this country swelled against the measure, Mr. Anastasiades delayed an emergency parliamentary vote on the bailout plan until Tuesday, the second step in as many days. Faced with a lack of support from lawmakers, the vote could be delayed until as late as Friday.

The government also said it would keep Cypriot banks shuttered until at least Wednesday, beyond a bank holiday that was supposed to end Monday, a move aimed at staving off a possible bank run.

Cyprus's banking association issued a statement calling on people to remain "calm," saying it was ready to implement whatever measures were needed to protect the stability of the banking sector. The association said it would instruct banks to load automated teller machines with cash while banks remained closed.

Financial markets stuttered on the news, with Asian stocks suffering the most, closing down about 2 percent. European market indexes were off about 1 percent by the end of the session, and Wall Street shares were less than 0.2 percent lower in afternoon trading.

For the first time since the onset of the euro zone sovereign debt crisis and the bailouts of Greece, Portugal and Ireland, ordinary depositors — including those with insured accounts — were being called on to bear part of the cost, €5.8 billion.

The previous bailouts have been financed by taxpayers, and the new direction raised fears that depositors in Spain or Italy, two countries that have struggled economically of late, might also take flight.

A crowd of protesters gathered in front of the presidential palace, shouting angrily at Mr. Anastasiades and inveighing against Germany and European leaders as he entered the building to meet with his cabinet. "Merkel, U stole our life savings," read one banner tied to a bus stop. "EU, who is next, Spain or Italy?" read another.

Miguel Arias CaƱete, Spain's agriculture minister, told journalists in Brussels on the sidelines of a European Union meeting on Monday that he saw no risk of contagion. Spain's banking system had undergone "a very rigorous clean-up," the minister said, and were now in a "magnificent situation" following their bailout last year.

The finance ministers from the euro zone countries were to take up the Cyprus issue on a conference call later Monday. Jeroen Dijsselbloem, the president of the group, had declined Saturday to rule out taxes on depositors in countries beyond Cyprus, although he said such a measure was not being actively considered.

A key question for the finance ministers was expected to be whether any revised formula for the tax on deposits could still deliver the 5.8 billion euros agreed to in the bailout deal. The plan, a so-called bail-in, also would wipe out 1.4 billion euros held by junior bondholders in Cypriot banks. Only senior bondholders, who have paid a premium to be first in line for repayment of their investments, would be fully protected.

Joerg Asmussen, a member of the European Central Bank governing council, suggested that creditors may not object to a revision of the bailout terms.

RNC 'Autopsy' Calls for Outreach to... - ABC News

In what they called the "most comprehensive post-election review" ever made of an electoral loss, the Republican National Committee and a group of project co-chairs unveiled a report today saying that they need to open their playbook and put their "cards on the table face up" in order to win presidential elections in the future.

While unveiling the 100-page report at the National Press Club today, RNC Chairman Reince Priebus said he wanted the report, or autopsy, to be "honest" and "raw," stressing the message of inclusion to Americans who might not be on board with all the party's policies.

"Our message was weak; our ground game was insufficient; we weren't inclusive; we were behind in both data and digital; our primary and debate process needed improvement," Priebus said of Mitt Romney and the GOP's 2012 loss. "There's no one solution. There's a long list of them."

The report, called the "Growth and Opportunity Project," lays out an extensive plan the RNC believes will lead the party to victory with an extensive outreach to women, African-American, Asian, Hispanic and gay voters. Among the plans: hiring paid outreach staffers across the country in a $10 million push that begins right away; backing "comprehensive immigration reform"; abbreviating the presidential primary process with fewer debates, specifically saying the party would like at least half the 20 there were during the 2012 cycle; and moving the convention to June or July, as well as improving the data and digital effort.

Priebus noted that the party's policies are fundamentally sound but require a softer tone and broader outreach, include a stronger push for African-American, Latino, Asian, women and gay voters.

"To be clear, our principles our sound, our principles are not old rusty thoughts in some book," Priebus said, but the "report notes the way we communicate our principles isn't resonating widely enough."

Priebus added: "I think our policies are sound, but I think in many ways the way we communicate can be a real problem."

The report also specifically states that there needs to be more inclusion. "We need to campaign among Hispanic, black, Asian, and gay Americans and demonstrate we care about them, too. We must recruit more candidates who come from minority communities. But it is not just tone that counts. Policy always matters."

Sally Bradshaw, a Florida GOP strategist and one of the project's co-chairs, said the party has been "continually marginalizing itself and unless changes are made it will be increasingly difficult for Republicans to win another presidential election in the near future."

"Public perception of our party is at record lows," Bradshaw said. "Young voters are increasingly rolling their eyes at what the party represents and many minorities think Republicans don't like them or don't want them in our country. When someone rolls their eyes at us they aren't likely to open their ears to us."

Bradshaw added that the GOP "needs to stop talking to itself" and needs to open the tent in order to win presidential elections in the future.

"We have become expert at how to provide ideological information to like-minded people but ,devastatingly, we have lost the ability to be persuasive with or welcoming to those who don't agree with us on every issue," Bradshaw said, noting they need to be "inviting and inspiring."

(CBS News) - Two former star high school football players broke down and openly wept on Sunday morning in court after being found guilty of raping a 16-year-old girl during a night of partying last August.

Ma'Lik Richmond, 16, and Trent Mays, 17, had been charged with digitally penetrating the intoxicated girl twice on the night of August 11, 2012. Richmond and Mays were found delinquent, which is the juvenile equivalent of being found guilty. Mays was also convicted of a second felony charge of using a minor in nudity oriented materials for taking and distributing photographs of the victim in states of undress.

When the verdict was read both defendants began sobbing. 

"I'm aware this is the first time they have been in trouble with the law, but these are serious offenses," said Judge Thomas Lipps, who decided the case without a jury. "If they were convicted in an adult court of these charges they would be spending many years in an adult prison."

Judge Lipps sentenced Richmond to a minimum of one year incarceration in a juvenile facility. Mays was sentenced to a minimum of one year incarceration in a juvenile facility for the rape, and one year for the second felony, to be served consecutively. Lipps called Mays' crimes "more egregious" than Richmond's. Both teens were facing a maximum sentence of incarceration until age 21.

After announcing the verdict, Judge Lipps allowed the defendants and their families time to speak.

Mays rose and said "no pictures should have been sent around, let along even taken." Richmond, crying loudly, said "I had no intention to do anything like that."

Ma'Lik's father, Nathaniel Richmond, stood up and said that he had been an alcoholic in the past and was aware of the dangers associated with heavy drinking.

Richmond, who did not raise his son, spoke to the victim's family, saying, "I'm sorry for what you all had to go through. I hope somewhere in your hearts that you can forgive Trent and Ma'Lik for the pain they have caused your daughter."

Mays father said, "We're sorry for putting everybody through this...Ma'Lik's family, the community, the school, everybody else."

Over four long days of testimony, multiple teen witnesses testified that the victim was highly intoxicated, with various witnesses recalling her slurring her speech, stumbling and vomiting. More than one said they saw one or both of the defendants use their fingers to penetrate the girl but didn't recognize that as rape.

The defense attempted to argue that, although she was drunk, she was capable of making decisions and consenting to sexual contact.

On Saturday, the girl at the center of the case testified for more than an hour, saying she did not recall the night in question and only became aware of what had happened to her when she started seeing pictures of herself and postings about the night on social media, reports the Cleveland Plain Dealer.

Indian Police Arrest 5 Over Swiss Tourist's Rape - Voice of America

Indian police have arrested five men who confessed to gang-raping a Swiss tourist in central Madya Pradesh state.

The 39-year-old woman was on a cycling trip with her husband when they were attacked by a group of men at their forest campsite near a road after visiting the temple town of Orchha.

Deputy police inspector D.K. Arya said the men beat the husband and raped the woman in front of him. They stole a laptop, 10,000 rupees and a mobile phone from the couple.

Arya said six or seven men attacked the Swiss couple in their tent and at least four of them raped the woman, who was later treated at a local hospital and released.

The Swiss ambassador to India, Linus von Castelmur, said late Saturday that he had spoken with the couple and demanded a swift probe of the incident by Indian authorities.

The woman and her husband were on their way to Agra, the home of the Taj Mahal. The journey was part of a three-month cycling tour from Mumbai to New Delhi.

The attack is the latest example of violent sexual assaults on women in India. It comes three months after outrage and nationwide protests erupted following the fatal gang-rape of a 23-year-old student by five men and a juvenile on a bus in New Delhi last December.

That attack prompted demands that the government do more to protect women.

According to India's National Crime Records Bureau, one woman is raped every 20 minutes in India. But police say many incidents go unreported due to the stigma attached to such crimes.

    Former House Speaker Newt Gingrich, seen by many in the Republican Party as an "ideas man," slammed as a "false attack" the argument that conservatives "don't need new ideas" during a speech before the Conservative Political Action Conference on Saturday, repeatedly scalding the Republican establishment for being "mired in stupidity."

    "The Republican establishment is just plain wrong about how it approaches politics," Gingrich said. "We have to disenthrall ourselves of the establishment's anti-idea approach."

    "You're going to hear a false attack that we don't need new ideas," he continued. "Let me draw a distinction: we don't need new principles, but we need lots of new ideas about how to implement those principles in the 21st century."

    Again and again, Gingrich lit into both Republicans and Democrats for what he characterized as their myopic policy mindset. "We stand today on the edge of a great future, but Washington is blind to it in both parties," he said. "I've been trying for two-and-a-half years to get the House Republicans to understand. They control every committee and every subcommittee in the House; they could be having a hearing every week on" the promise of the future.

    Unfortunately, Gingrich said, the GOP is "determined to avoid" thinking about it.

    "It is virtually impossible to get people in Washington, D.C., to actually learn how to think about a new world," he said. "It is sobering to me to be standing here, as a senior member of this party, telling you from 1976 to 2013 we have the dominant wing of this party, which has learned nothing and is as mired in the past and mired in stupidity as it was in 1976."

    "There are dozens of new areas where we're about to breakout, and we're about to have a dramatically better opportunity," he said, "and this city, in both parties, is literally blind to the great potential of this country."

    "I do believe that we ought to focus on the right to rise," Gingrich said. "We should unflinchingly stand for the right to life, because that's the predicate to the right to rise."

    He closed by saying he was "very excited" about the recent elevation of Pope Francis, "who I believe is going to challenge all of us."

    "He's going to challenge the left on social policy, and he's going to challenge the right on thinking about the poor," Gingrich said, "and I think that's good for all of us."

    Dow ends 10-day winning streak

    NEW YORK: US stocks fell on Friday, bringing the Dow's 10-day winning streak to a halt as a decline in a key consumer sentiment index highlighted continuing weaknesses in the economy.

    Trade was heavy in banks after the Fed completed its stress tests and capital plan reviews while a Senate committee report blasted JPMorgan Chase for how it handled its massive "London Whale" losses last year.

    The Dow Jones Industrial Average finished down 25.03 points (0.17 per cent) to 14,514.11, the first time in nine days it did not set a fresh record.

    The broad-based S&P 500 lost 2.53 points (0.16 per cent) at 1,560.70, after having pushed higher on Thursday to a tantalizing three points short of its all-time high.

    The tech-heavy Nasdaq Composite dropped 9.86 points (0.30 per cent) to 3,249.07.

    Share opened lower and lost further ground after the University of Michigan Consumer index took a surprising dive to 71.8, its lowest level since the end of 2011 and down from 77.6 in February. Analysts had expected a gain.

    JPMorgan shares sank 1.9 per cent after a US Senate report painted a damning picture of its handling of the massive "London Whale" derivatives losses last year.

    In addition on Thursday, the Federal Reserve raised questions about its capital plans, ordering adjustments to "address weaknesses" if it wants to proceed with dividend payouts and share buybacks as hoped.

    Goldman Sachs shares added 0.5 per cent despite its capital plan getting the same treatment as JPMorgan's from the Fed.

    Bank of America, whose capital plan was fully approved by the Fed after having been stalled last year, gained 3.8 per cent and Wells Fargo added 3.3 per cent.

    But Citigroup lost 0.4 per cent despite it also getting the nod for a share buyback.

    Boeing shares added 2.1 per cent after company officials said they believed the grounded 787 Dreamliner was "absolutely" safe and would be back flying within weeks after getting a tentative approval of its fix for battery problems that sparked a fire on one aircraft.

    On the Nasdaq, Apple was up 2.6 per cent after rival Samsung's new smartphone Galaxy S4 failed to generate a surge of excitement. -- AFP

    Vatican Rejects Argentine Accusations Against Pope Francis - New York Times

    VATICAN CITY — For the first time since the election of Pope Francis two days ago, the Vatican on Friday formally defended him from accusations that, decades ago, in the so-called Dirty War in his home country of Argentina, he knew about serious human rights abuses but failed to do enough to halt them.

    The Rev. Federico Lombardi, the Vatican spokesman, said there had "never been a credible accusation against him" relating to the period in the 1970s when he was the superior of the Jesuit order in Argentina.

    Indeed, "there have been many declarations of how much he did for many people to protect them from the military dictatorship," Father Lombardi said in a statement at a news conference.

    "The accusations belong to the use of a historical-social analysis of facts for many years by the anticlerical left to attack the church and must be rejected decisively."

    Pope Francis, the former Cardinal Jorge Mario Bergoglio of Buenos Aires, was elected by fellow cardinals on Wednesday and much of his behavior since then has seemed to indicate a shift of tone at the Vatican to a more humble and frugal approach.

    When he addressed cardinals on Friday, for instance, he spoke frequently without notes, addressing them as "Brother Cardinals" rather than as the more usual "Lord Cardinals" and the Vatican press office highlighted other shows of modesty and lack of formality since his election.

    But the question of his past has never been far below the surface, rekindling accusations relating to a conflict in which as many as 30,000 people were disappeared, tortured or killed by the dictatorship.

    At the news conference on Friday, Father Lombardi repeated assertions by a prominent human rights campaigner that there had been "no compromise by Cardinal Bergoglio with the dictatorship."

    The debate has simmered in Argentina, with journalists there publishing articles and books that appear to contradict Cardinal Bergoglio's account of his actions. These accounts draw not only on documents from the period, but also on statements by priests and lay workers who clashed with Cardinal Bergoglio.

    After the church had denied for years any involvement with the dictatorship, he testified in 2010 that he had met secretly with Gen. Jorge Videla, the former head of the military junta, and Adm. Emilio Massera, the commander of the navy, to ask for the release of two kidnapped priests. The following year, prosecutors called him to the witness stand to testify on the military junta's systematic kidnapping of children, a subject he was also accused of knowing about but failing to prevent.

    In a long interview published by an Argentine newspaper in 2010, Francis — then still a cardinal — said that he had helped hide people being sought for arrest or disappearance by the military because of their political views, had helped others leave Argentina and had lobbied the country's military rulers directly for the release and protection of others.

    The renewed discussion of the case intruded into a day when Francis earlier offered warm praise on Friday to his predecessor, Benedict XVI, saying that his nearly eight years as leader of the world's 1.2 billion Roman Catholics had "lit a flame in the depths of our hearts."

    Speaking to the church's cardinals, he urged them to persevere and find ways to spread word of their faith around the world.

    "Let us not give in to pessimism, to that bitterness that the devil offers us every day," he said. But he offered no direct allusion to the myriad challenges facing the Vatican from a series of sexual abuse, financial and other scandals that swamped much of Benedict's papacy.

    According to the officials, Francis frequently extemporizes, making it more difficult for the papal press office to deliver texts of addresses like Friday's.

    "That's the cost of having such spontaneity," said Rev. Thomas Rosica, a Vatican spokesman.

    But there was one clearly unchoreographed moment. Francis, 76, stumbled briefly as he greeted the dean of the College of Cardinals, Angelo Sodano, but swiftly recovered.

    The pope also sent a message on Friday to Rome's chief rabbi, saying he wished to pursue closer ties between Catholics and Jews.

    "I hope very much to be able to contribute to the progress in relations between Jews and Catholics" since the Second Vatican Council in the early 1960s, the pope said in a message to the rabbi, Riccardo di Segni.

    Francis is the first non-European pope for over 1,200 years and the first from the Americas. In a further display of his embrace of the poor, Vatican officials said on Friday that Francis had urged bishops and the faithful in Argentina not to spend money on a long journey to attend his formal inauguration next Tuesday but to make a donation to the poor.

    In his first audience with the cardinals, Francis told them that Benedict's papacy and teachings had "enriched and invigorated" the Catholic Church and had "lit a flame in the depths of our hearts that will continue to burn because it is fueled by his prayers that will support the church on its missionary path."

    Vatican officials said the new pope planned at some stage to visit Benedict at the papal summer retreat at Castel Gandolfo outside Rome, where he is living while an apartment is made ready for him at the Vatican. In his retirement, Benedict has said, he plans to live "hidden to the world."

    Last month, Benedict became the first pope in six centuries to resign, citing failing powers and old age and precipitating a scramble for the succession in which Francis was not widely seen as being among the front-runners. Sometimes speaking without notes, Francis observed Friday that many of the cardinals were of advanced age, and he told them: "Let us give this wisdom to young people; like good wine, it becomes better with age. Let us give to young people the wisdom of life."

    After his remarks, Francis greeted the cardinals one by one, shaking their hands and hugging some. He also accepted letters and presents from them, including a yellow bracelet that he immediately wore on his right wrist.

    JPMorgan Faulted on Controls and Disclosure in Trading Loss - New York Times

    JPMorgan Chase, the nation's biggest bank, ignored internal controls and manipulated documents as it racked up trading losses last year, while its influential chief executive, Jamie Dimon, briefly withheld some information from regulators, a new Senate report says.

    The findings by the Congressional investigators shed new light on the multibillion-dollar trading blunder, which has claimed the jobs of several top executives and prompted an inquiry by the Federal Bureau of Investigation. The 300-page report, released a day before a Senate subcommittee plans to question bank executives and regulators at a hearing, will escalate the debate over how to police complex risk-taking on Wall Street. It may also foreshadow a criminal case against employees at the heart of the troubled wager.

    A spokeswoman for the bank said on Thursday, "While we have repeatedly acknowledged significant mistakes, our senior management acted in good faith and never had any intent to mislead anyone."

    Mr. Dimon, whose reputation as an astute manager of risk has been undercut by the trading losses, comes under the harshest criticism yet from the Senate investigators. The chief executive signed off on changes to an internal alarm system that underestimated losses, seemingly contradicting his earlier statements to lawmakers, according to the report.

    He is also accused of withholding from regulators details about the investment bank's daily losses — and then raising "his voice in anger" at a deputy who later turned over the information.

    While people close to the matter dispute whether the outburst actually happened, it illustrates a broader problem at JPMorgan: after emerging from the financial crisis in far better shape than rivals, the bank saw itself as being above its regulators. The bank was so filled with hubris, Senate investigators said, that an executive once screamed at examiners and called them "stupid."

    The bipartisan report, citing some of the same private documents that F.B.I. agents are now poring over, also highlighted how JPMorgan managers "pressured" traders to lowball losses by $660 million, a previously undisclosed figure, and then played down the problems to authorities.

    The bank's trader who became known as the London Whale — because of the outsize derivatives trades at the center of the bank's losses, which now total more than $6 billion — told a colleague last year that the bank's estimated losses were "getting idiotic," according to a transcript of their phone conversation cited by the subcommittee. The trader, Bruno Iksil, added that "I can't keep this going" and that he didn't know where his boss in London "wants to stop."

    Federal investigators, seeking Mr. Iksil's side of the story, now plan to interview the trader overseas, according to people briefed on the investigation.

    Timeline: JPMorgan Trading Loss

    After examining hundreds of e-mails and hours of taped phone calls, the people said, federal investigators also plan to interview top JPMorgan executives in the coming weeks, including Mr. Dimon. While authorities do not suspect the chief executive of wrongdoing, the meetings signal that the case is at an advanced stage.

    The breakdowns at both the bank and at its regulators, in particular the Office of the Comptroller of the Currency, could galvanize support for new curbs on Wall Street trading.

    Calling the bank's trading strategy a "runaway train that barreled through every risk warning," Senator Carl Levin, the Michigan Democrat who runs the Permanent Subcommittee on Investigations, said that the bank "exposed daunting vulnerabilities" in the financial system.

    Demands from regulators for more information were met with resistance at JPMorgan, the subcommittee said. The pushback extended to the highest levels of the bank, the report found, and was not limited to requests about the bank's chief investment office, where the losses took place.

    For a brief period in 2012, the subcommittee said, JPMorgan stopped providing profit and loss reports for the investment bank to the comptroller's office. Mr. Dimon, the subcommittee said, had choked off delivery of the reports because he thought "it was too much information to provide."

    Some people briefed on the matter dispute that characterization, noting that the reports were briefly halted because of security concerns.

    Yet at other times, the bank was not fully forthcoming, Senate investigators said. During a meeting in January 2012 with the comptroller's office, JPMorgan said it intended to reduce the size of the complex trading bet. Instead, the bank increased the positions.

    Ina Drew, who headed the chief investment office, balked at the regulator's demands for more information, resisting them as "unnecessary and intrusive," the subcommittee said in its report.

    Bryan Hubbard, a spokesman for the currency office, said the agency acknowledged there "were shortcomings in the O.C.C. supervision leading up to and responding to the unfolding events" with JPMorgan's chief investment office.

    He added that "as the bank revealed the true nature of the C.I.O. operation and the level of loss exposure, the comptroller escalated the agency's response and ordered a two-pronged review into the bank's actions as well as the O.C.C.'s."

    JPMorgan faces the most scrutiny over its lowball estimates of losses, the topic of the F.B.I.'s investigation. While traders have leeway to value their losses, the bank in 2012 moved from marking them in a "middle range" to some of the most generous possible figures.

    One junior trader in London, Julien Grout, told Mr. Iksil in a recorded phone conversation: "I am not marking at mids as per a previous conversation." For five days in March, Mr. Grout also kept a spreadsheet that tracked the difference between his valuations and the midpoint. The documents, according to the subcommittee, showed that his valuations underestimated the losses by $432 million.

    The bank's controller, alerted to potential problems, issued an internal report in May 2012 that essentially cleared the traders of wrongdoing. The marks, according to the report, were "consistent with industry practices."

    But JPMorgan, the subcommittee noted, later had to restate its earnings to reflect the overly rosy estimates.

    "The bank said the markings complied with the standards of the industry," Mr. Levin said. "We don't think that's true."

    Mr. Levin called for new rules that would force banks to strengthen their methods for valuing their trades. He also urged regulators to finalize the so-called Volcker Rule, which would prevent banks from making such bets with their own money.

    JPMorgan, the subcommittee noted, "mischaracterized high risk trading as hedging," or mitigating risk, which is allowed under the Volcker Rule. Douglas Braunstein, the bank's chief financial officer, told analysts in April that the position "is consistent" with a proposed version of the Volcker Rule, a conclusion that the subcommittee dismissed as false.

    One regulator wrote in a May 2012 e-mail that the position was a "make believe voodoo magic 'composite hedge.' "

    As the traders in London assembled increasingly complex bets, JPMorgan ignored its own risk alarms, according to investigators. In the first four months of 2012 alone, the report found, the chief investment office breached five of its critical risk controls more than 330 times.

    Instead of scaling back the risk, though, JPMorgan changed how it measured it, in a metric known as value at risk, or VaR, in January 2012, enabling the traders to continue building the big bets, the subcommittee found.

    The report provides further detail about what Mr. Dimon knew about the changed alarm system. Mr. Dimon told the subcommittee that he couldn't "recall any details in connection with approving the VaR limit increase."

    But Mr. Dimon personally authorized JPMorgan to temporarily increase the measure, writing in a January 2012 e-mail, "I approve."

    Singapore banks drop ringgit reference rate?

    SINGAPORE: Banks in Singapore will likely abandon their reference rate for the Malaysian ringgit, a person with knowledge of the matter told Reuters, handing a victory to Malaysia's central bank as it seeks greater control over its currency market.

    Singapore's foreign exchange market has come under pressure for change since regulators, spurred by a global scandal over bankers rigging key lending rates, ordered reviews last autumn into various rates set by the city-state's banking association.

    The probes uncovered attempts by traders to manipulate Singapore's rate fixings for certain currencies, fuelling the ire of central bankers in Malaysia and Indonesia who for years have held concerns about the impact of offshore speculation on their own spot currency markets.

    The Association of Banks in Singapore, which is hammering out reforms to improve the integrity of its rate settings, is expected to adopt a plan that would end the daily publication of a ringgit spot price for settling derivative contracts, said the person, a banking professional with direct knowledge of the plans who did not want to be named as the plans were not public.

    A spokesman for the Association of Banks in Singapore declined to comment on the matter. The Monetary Authority of Singapore provided no comment.

    No final decision has been made on whether to discontinue the offshore ringgit rate and discussions are continuing about how to reform the system, several banking sources involved in the process have told Reuters.

    Even the consideration of dropping the offshore ringgit rate shows the pressure Singapore faces from its neighbours and the impact of the global regulatory push for greater transparency in
    over-the-counter derivatives.

    The association has not shown any movement toward ending Singapore's rate fixing for the Indonesian rupiah, which market players say lacks a reliable spot reference rate in its home country compared with Malaysia's reference rate for the ringgit.

    Over the past two years, the Singapore fixing has consistently quoted the rupiah at rates against the dollar that are weaker than the onshore rates, with the spread widening as far as 250 rupiah at the start of this year. The spread between onshore and offshore rates for the ringgit fixing is usually close to zero.

    The derivatives priced against the reference rates, known as non-deliverable forwards (NDFs), are instrumental for companies, investors and traders seeking to hedge currency risk in countries where capital controls restrict foreign money flows.

    With the end of Singapore's ringgit rate, banks trading ringgit NDFs would refer to a benchmark published by the foreign exchange industry association in Malaysia, the person said.

    That would still fall short of the ideal solution - a benchmark based on actual transactions - but it would be better than the offshore model, said Joseph Cherian, director of the Centre for Asset Management Research & Investments at NUS Business School in Singapore.

    "When vested interests like offshore bankers set reference rates, be it interest or foreign exchange, and have their profit and loss - and by extension, their compensation - determined by the very rates they set, the temptation to do wrong is always high," he said.

    Singapore's NDF market is one of the world's largest with turnover that can reach billions of dollars per day. Most trade is in the Indian rupee, for which reference rates are overseen by India's central bank, and in Southeast Asian currencies.

    Some central banks, including Indonesia's, have long complained that speculation by NDF traders has made the spot rates for their currencies more volatile.

    To determine Singapore's daily currency reference rates for the ringgit, a panel of 15 banks submits estimates of onshore spot rates every trading day. The fixing takes the average of bank
    contributions, after removing the top and bottom quarter of submissions.

    Thomson Reuters, parent of Reuters news, acts as the agent for the Association of Banks in Singapore, collecting and calculating the rates. A similar process is used for interbank lending rates in Singapore and other financial centres around the world.

    The move to a locally set rate is both a vote of confidence in the credibility of Malaysia's onshore rates, and a signal of banks' reluctance to remain involved in an offshore rate-setting
    process that has become mired in controversy.

    It also reflects momentum for regulators to crack down on rate fixing systems after last year's scandal over the setting of the benchmark London interbank offered rate (Libor), which found traders worldwide were manipulating daily lending rates tied to more than US$600 trillion worth of securities.

    The review into Libor in London is proposing to reduce the number of interest rate benchmarks and tighten the oversight of the rate-setting process.-- Reuters

    KL shares open mixed in early trading

    Share prices were mixed in early trading Friday after two days of losses on renewed buying interest in lower liners, dealers said.

    At 9.15am, the FTSE Bursa Malaysia KLCI (FBM KLCI) eased 0.91 of a point to 1,639.83. It had opened 0.61 of a point better at 1,641.35.

    HwangDBS Vickers Research Sdn Bhd said the bellwether FBM KLCI could extend its recovery after bouncing up from a trough of 1,635.87 yesterday.

    "For the time being, we expect the benchmark index to swing between its immediate support and resistance levels of 1,635 and 1,655, respectively," HwangDBS said in a research note today.

    Meanwhile, the key US equity indices posted an overnight rebound of between 0.4 per cent and 0.6 per cent as sentiments were boosted by a drop in jobless claims.

    "As such, Asian equities will probably show a positive bias when trading resumes today," the research firm said.

    Meanwhile, the Plantation Index lost 13.46 points to 7,896.8, the Industrial Index fell 10.08 points to 2,815.48 while the Finance Index dwindled 12.54 points to 15,277.51.

    The FBM Emas Index declined 3.97 points to 11,219.51, the FBMT100 shed 5.52 points to 11,059.37, the FBM Mid 70 Index went down 3.15 points to 12,463.48 and the FBM Ace Index slid 10.03 points to 3,963.21.

    Gainers outnumbered losers 89 to 63, with 103 counters unchanged, 1,387 untraded and 20 others suspended.

    Turnover stood at 54.34 million shares worth RM35.21 million.

    Among actives, Luster Industries and MNC Wireless earned half sen each to 10.5 sen and 11 sen, respectively, Sanichi Technology added one sen to 12.5 sen, while Censof Holdings eased half sen to 43 sen.

    Heavyweights, Maybank rose four sen to RM9.25, CIMB slipped two sen to RM7.07, while Sime Darby and Axiata were flat at RM9.19 and RM6.39, respectively.-- Bernama
