No by-election following the death of BN assemblyman

KUALA PILAH: There will be no by-election in the state following the death of Barisan Nasional's Johol state assemblyman, Datuk Roslan Md Yusof, 58 this morning.

Article 54 (1) of the Federal Constitution states that by-elections only need to be held within the first three of the five-year mandate.

Negeri Sembilan is among other states that reached its three-year mandate simultaneously with that of Parliament which was on April 28 following the March 2008 general election. The current Parliament term ends in April 2013.


After the cut-off period, a by-election will only be held if there is a special need which includes a hung government. The BN holds 21 of the the 36 state seats in Negeri Sembilan.

Since the 12th general election, a total 16 by-elections were held - six for parliamentary seats and 10 for state seats.

KUALA PILAH: Johol Assemblyman Datuk Roslan Md Yusof, 58, from Barisan Nasional (BN) died about 4.45am today at the Tunku Ampuan Najihah Hospital here.

During the 2008 general election, he defeated Kamarudin Md Tahir from Pas with a 1,263 majority.

Roslan, who was the Kuala Pilah Umno division vice-chief leaves behind his wife, Datin Zawayah Marzuki, 53, and eight children between the ages of 17 - 28 years.


A former teacher, Roslan first won the state seat in the 2004 general election.

He was admitted to the hospital yesterday after he complained of breathing difficulties.

Two years ago, Roslan was reported to have injured his back after he fell during a badminton game and had undergone surgery as well as physiotherapy at the Kuala Lumpur Hospital earlier this year.


According to his eldest son, Mohd Hafizi, his father's remains was taken to their residence in Kampung Berambai, Johol and would be buried at the Kampung Cabang Dua Muslim Cemetary in Johol after the Zohor prayers.

MPPP issues stop-work order on Kek Lok Si Temple car park

GEORGE TOWN: The Penang Island Municipal Council (MPPP) has slapped a stop-work order on the proposed car park project at the Kek Lok Si Temple which is being constructed with approval.

Construction works have already started at the prject, which cost RM10 million.

State Local Government committee chairman Chow Kon Yeow said the council had only approved plans for another nearby project but the temple started work elsewhere too.


Chow said the temple has also been ordered to submit its contruction plans for the parking on the 7 acre lot to the council immediately.

"As a temporary measure, it (temple) has also been ordered to place plastic sheets on the partially developed land as this can pose as a threat to the public when there is a heavy downpour and to take necessary precaution measures so as to not put the public in harm's way," he said.

Senior citizen killed in tower crane accident

GEORGE TOWN: A 65-year-old welder was killed after a seven-storey tall tower crane toppled and crushed a pre-war house within the heritage enclave early this morning.

Liang Yit Kwang, 65, died in his sleep when the crane collapsed on the shoplot at the junction of Jalan Transfer and Jalan Sri Bahari.

The deceased from Gurun, Kedah died in his bedroom when the steel structure landed on top of him.


The crane was placed at a hotel construction site opposite the shoplot. The toppled crane also partially damaged another shoplot.

Another three people, including a woman in the same shoplot, aged between 54 and 79, were also injured. They suffered multiple head and bodily injuries. The trio have been warded at the Penang Hospital.

Both sides display professionalism

GUA MUSANG: Leaders from both the Barisan Nasional and Pas demonstrated a high level of professionalism during nominations for the Galas state seat today, ensuring a smooth, fast and clean nomination process.

The BN delegation was led by Umno vice-president, Datuk Seri Dr Ahmad Zahid Hamidi, Wanita Umno chief, Datuk Seri Shahrizat Abdul Jalil, Wanita MCA chief, Datuk Ng Yen Yen and Umno Youth chief Khairy Jamaluddin, while the Pas delegation was helmed by its party president, Datuk Seri Abdul Hadi Awang, spiritual leader Datuk Nik Aziz Nik Mat, Parti Keadilan Rakyat vice-president Azmin Ali and DAP adviser Lim Kit Siang.

Both delegations arrived separately and though seated in different tents were seen chatting with each other in a very cordial and peaceful manner.


At one point, Shahrizat was seen leading a delegation of Wanita Umno members to visit the Opposition tent.

There, Shahrizat warmly greeted Hadi Awang, who stood up to greet her, along with Kit Siang and Azmin.

Hadi Awang asked Shahrizat how the recently concluded Umno general assembly had progressed and congratulated her on a smooth and successful assembly.


"It went well. There were no problems and everyone was happy," said Shahrizat, who also took time to ask Kit Siang about his health.

"I'm well ... how about you," asked the DAP stalwart.

The group then spent a few minutes chatting and later returned to their respective camps.


Overall, there was not a single untoward incident and supporters from both sides demonstrated a high level of professionalism.

"We are very happy with how the nominations progressed and hope this same kind of spirit will prevail throughout the campaign period and on polling day also," said Kelantan police chief, Datuk Abdul Rahim Hanafi.

Abdul Rahim has assured both the Barisan Nasional, who will be fielding Abdul Aziz Yusoff, 49, for the seat and Pas' Dr Zulkefli Mohamed,44, that the police will not reject any permits for ceramahs, as long as it is submitted a day earlier.

There were more than 500 supporters on each side and police, who had anticipated large crowds had took steps to place the groups 180 metres apart as opposed to only 60 metres as in previous by-elections.

There was also very smooth traffic flow, with no major disturbances to the locals who were busy on their way to work.

"We did not close any major roads and did our best not to disturb the daily lives of the people here," said Abdul Rahim.

New faces expected in Sarawak election

KUCHING: The coming state election may see the most number of new faces within the Sarawak Barisan Nasional in its history.

In the past, it has been the practice of BN to maintain the incumbents to ensure political stability - the fewer changes made, the less risk would be at stake.

However, since the last state election in 2006, the general public's mentality seems to have shifted to opt for new blood and younger state representatives, especially after the op position made it a point to recruit young professionals with no historical baggage or even political background to stand as their candidates.


While BN had little time to react to this change in the last state election, this time around, however, one can expect to see BN putting forth new faces to replace some of the incumbents, especially those who did not secure impressive majorities in the last state elections.

Parti Pesaka Bumiputera Bersatu (PBB), for instance, did not wait for the coming election to make known its intention to replace some of the incumbents.

As early as November 2008, its president Tan Sri Taib Mahmud replaced three PBB assistant ministers when reshuffling his Cabinet - Datuk Bolhassan Di (Assistant Minister of Infrastructure Development and Communica tion), Datuk Hamden Ahmad (Assistant Minister of Youth as well as Tourism) and Datuk Ambrose Blikau (Assistant Minister of Rural Development as well as Public Utilities).


With growing rumours that a state election would take place March 26 (which coincides with Taib's 30th an niversary as Chief Minister) next year, there are predictions that more than a handful of PBB incumbents would be dropped after Taib's declaration of 30 per cent new faces.

PBB was allocated 35 out of the 71 state seats in the last elections and 30 per cent new faces would mean 10 new candidates, which was also confirmed by party insiders.

Those on top of the list speculated to be dropped are the three dropped assistant minsiters Bolhassan (Beting Maro), Hamden (Belawai) and Blikau (Katibas).


Others included Dr Wahbi Junaidi (Saribas; 94-vote ma jority), Simoi Peri (Lingga; 1870-vote majority), Gramong Juna (Machan; 2,289-vote majority), Frederick Bayoi (Kedup; 1981-vote majority) and Wan Wahap (Sadong Jaya, 858-vote majority).

Sarawak United People's Party (SUPP), meanwhile, has been going on its rounds to solve issues, reaching out to young voters and recruiting thousands of them. SUPP has also produced dramas to rekindle among the veteran party members their initial love and sacrifice for the party.

These efforts were taken note of by the Chinese, but initial grassroots feedback seems to indicate no significant impact as yet on Chinese voters.

"Every day, we make it a point to spend time with our voters. We are experiencing a total transformation especially with regards to our candidates," said its president Tan Sri Dr George Chan Hong Nam.

SUPP plans to put forth at least 30 per cent new faces and no "recycled candidates". These changes are expected in all the areas it had lost ground previously, such as Padungan, Pending, Batu Lintang, Kidurong, Merandong and Bukit Assek. SUPP has 19 allocated constituencies.

Only one recycled candidate would be expected, namely Datuk Alfred Yap, contesting in Kota Sentosa which he lost by 531 votes to Sarawak DAP secretary general Chong Chieng Jen.

For Parti Rakyat Sarawak (PRS) which has been allocated nine seats, its president Datuk Seri Dr James Masing has stated that there would be at least two new faces, speculated to be at Ngemah and Pelagus.

Ngemah was lost to Gabriel Adit, a former BN member who is now Parti Cinta Malaysia Sarawak state chief.

Pelagus, a seat of dispute due to Larry Sng's expulsion from the party after challenging Masing's presidency, remains a problem that BN needs to solve before the state elections is called.

To Masing, the Pelagus seat is non-negotiable.

Sng, who has been a partyless assistant minister over the last three years, would have to be absorbed by other component parties and contest in another constituency besides Pelagus if he wished to stand under the BN banner.

Speculation is that he would either stand in Meradong, the birthplace of his tycoon father-in-law Tan Sri Ting Phek Kiing, if he is to be absorbed by SUPP; or Meluan, replacing Wong Judat, should he be accepted by Sarawak Progressive Democratic Party (SPDP).

Holding eight seats, SPDP's president Datuk Seri William has said that he would retain all the incumbents.

However, it has been reported that the four state as semblymen within "the disgruntled five" namely Datuk Peter Nansian (Tasik Biru), Rosey Yunus (Bekenu), Sylvester Entri (Marudi) and Paulus Palu Gumbang (Batu Danau) would be replaced with new faces.

"The disgruntled five", which also includes Mas Gading Member of Parliament Datuk Dr Tiki Lafe, was given the nickname when they teamed up to call on party president Mawan to resign.

They claimed that Mawan, who is also the State Minister of Social Development and Urbanisation, was influenced by an invisible hand when he did not re-appoint Entri as the party secretary-general.

The five walked out from a SPDP supreme council meeting when Mawan replaced Entri.

LONDON: Arsene Wenger admits Arsenal cannot be regarded as title contenders after falling 12 points behind leaders Manchester United following their 2-1 defeat at north London rivals Tottenham.

Wenger endured another frustrating day as his side crashed to their fourth loss in seven league games at White Hart Lane.

Their disappointment was compounded by a potentially serious injury to Bacary Sagna who was taken to hospital with an ankle problem that could keep him out for several weeks.


Arsenal's dismal start to the season mean they sit just two points above the bottom three and Wenger accepts it is unrealistic to consider his side to be likely challengers for the championship while they are in their current plight.

"I think at the moment we have to set realistic targets like to say today we want to get in the Champions League positions," Wenger said.

"At the moment we are 12 points behind Man United and Man City, it's not realistic to say today we will win the league. We have to fight to come back into a better position, that is the reality."


Kyle Walker secured his side's victory with a 73rd minute goal after Arsenal midfielder Aaron Ramsey cancelled out Rafael van der Vaart's first-half opening goal.

Sagna was forced out of the game in the 68th minute of the game when he collided in mid-air with Spurs leftback Benoit Assou-Ekotto and landed against the perimeter fencing.

"We are very worried about his injury. He is in hospital at the moment but the first signs don't look good at all. It is fibula and ankle that has to be checked," Wenger said.


Wenger was clearly frustrated by the outcome and was involved in a confrontation with Clive Allen, one of the Tottenham coaching staff, as they made their way towards the tunnel after the final whistle.

Spurs manager Harry Redknapp said: "Arsene shook hands with me. I was pleased he shook hands with me. I think Clive went to shake hands with him and he missed Clive -- he didn't see him."

And Wenger confirmed: "I shook the hand of the manager and the assistant manager. How many people do I have to shake hands with? Is there a prescription? There were no words exchanged."

Redknapp admitted, however, that the abusive chants directed at Emmanuel Adebayor, Tottenham's former Arsenal striker, from Gunners fans had marred the occasion.

Vile chants were also directed by the home supporters towards Arsene Wenger and asked about chants Redknapp said: "It was disgusting. There was some pretty disgusting chanting at me but that's life.

"How do you chant something like that to someone? You can't be right mentally. You need help. There are kids up there as well." -- AFP

LONDON: Chelsea manager Andre Villas-Boas insists his team's 5-1 destruction of Bolton showed they have finally discovered the ruthless instincts required to win the Premier League.

Frank Lampard scored a hat-trick within an hour on his 350th league appearance for the club, while Daniel Sturridge scored twice as Chelsea routed Bolton, who had to settle for a consolation goal from Dedryck Boyata early in the second half at the Reebok Stadium on Sunday.

The Blues are now in third place, three points behind leaders Manchester United, and Villas-Boas is adamant it was about time Chelsea won by a big scoreline.


"We have been looking towards this victory for quite some time," he said. "It happened because we were more prolific in front of goal.

"I would like to dedicate the victory to my technical staff and my players.
"We have been chasing this victory for quite some time, we have deserved this for some time but for various reasons it hasn't been happening for us but it happened today.

"I don't think it's a statement. It is just something that fills us with pride because it is not as though we haven't been trying to do this before.

"We have been trying but football is a game full of uncertain things and for various reasons -- luck, a lack of efficiency -- we weren't able to find a result like this before.

"We have been creating the same volume of opportunities, today we were just more prolific and it paid off very, very well."

Lampard was the outstanding performer among many for Chelsea, especially given the uncertainty surrounding his future under the new Chelsea manager.

Whatever the future holds for the 33-year-old, he showed at the Reebok Stadium that he is not losing any of his scoring touch with age.

Chelsea now go into the international break hot on the heels of pacesetters United and Manchester City and with their manager in optimistic mood.

"Next week two title contenders play each other -- Liverpool and Manchester United -- then the two Manchester clubs play each other the following week," he said.

"It is important for us to continue to win and close the gap. We have a difficult game against Everton and a difficult game against QPR but hopefully, if we manage to get six points out of that, it will put us in a better position."

Bolton manager Owen Coyle has now seen his team lose 11 of their last 12 league games and six consecutive this season.

Yet he remained defiant in the face of growing pressure and criticism.
"I took stick as a player and I will take it as a manager," he said. "I'll be back on that training ground to work because all I want to do is put a smile on the fans' faces.

"People have said lovely things about me and the success I've had for six years. If I come in for criticism now, so be it. I'll take it on the chin because all I want to do is work hard for those fans." -- AFP

Fair values of SapuraCrest, Kencana cut

SapuraCrest Petroleum Bhd dropped 0.9 percent to RM3.48 set for its lowest close in a week.

Kencana Petroleum Bhd dropped 0.8 percent to RM2.40, its third day of declines.

SapuraCrest's "fair value" was cut to RM3.36 from RM4.56 and Kencana's was reduced to RM2.21 from RM2.99 at RHB Capital Bhd to reflect concerns about the global economy and the outlook for energy demand. -- Bloomberg

KLCC Property refinancing Islamic bonds

KLCC Property Holdings Bhd, co-owner of the 88-story Petronas Twin Towers in Kuala Lumpur, is refinancing its Islamic bonds after market yields dropped to the lowest level in more than two years.

The company will sell RM880 million (US$274 million) of 10-year securities to repay RM799 million of Syariah-compliant debt held by parent Petroliam Nasional Bhd, according to a Sept. 26 stock exchange filing. KLCC will pay a RM35.3 million penalty to redeem the securities, which were due to mature in November this year and next, the statement said. The developer didn't disclose who will buy the bonds.

Average yields on Malaysia's highest-rated corporate notes fell to 4.82 percent on Sept. 21, the lowest level since February 2009, according to an index compiled by Bank Negara Malaysia. Builder Encorp Bhd is also seeking to refinance some of its RM1.6 billion of sukuk, Cheong Hong Kit, the company's finance manager, said in an interview in Kuala Lumpur.

"Borrowers are taking advantage of the low-yield environment and strong demand for paper," said Edward Iskandar Toh, a bond manager at Areca Capital Sdn Bhd, which oversees RM500 million of assets in Kuala Lumpur. "Credit risk remains a concern in a difficult environment, hence rising demand for high-grade bonds," especially sukuk, he said.

Yields on longer-maturity Syariah-compliant bonds, which pay returns on assets to comply with Islam's ban on interest, may drop further as Europe's debt crisis deters investors from that region's assets and as the U.S. pumps funds into the world's biggest economy, Toh said. -- Bloomberg

Razin Mahmood has won the praise of his peers and the wonderment of the man on the street for his designs

AWARD-WINNING architect Razin Mahmood, 46, clearly loves his job.

But while the praise of the critics and respect of his peers are satisfying, nothing gives him greater gratification than the wonderment of the man on the street.


That's because his designs are as much skilful disguises as they are striking art, arousing curiosity as often as they inspire awe.

His surau in Nusa Idaman in Johor Baru, for which he received the gold medal for the special category at the Malaysian Institute of Architects (PAM) 2011 Awards, is an example of his brand of art.

Space is divided by glass and brick walls, allowing plenty of natural light and ventilation inside the building topped by a flat, square roof.


Futuristic, functional and eco-friendly, the surau does not, from whichever angle one approaches it, look like a surau.

He uses the "hutong" style of small narrow backlanes surrounded by wall on both sides to link the outside and the entrances to the congregation area.

The facade has shading panels with Chinese motifs.


This environmentally-friendly mosque is complete with a green roof and solar skylight.

If one had to guess at what the building might be, one would say shopping mall -- and one in Orchard Road, to boot.

It could also be an exhibition hall, auditorium, or a gallery.

The three district police stations -- Kota Tinggi and Nusajaya in Johor, and Cyberjaya in Selangor -- he designed look nothing like police stations.

There are big foyers, and corridors linking the blocks of buildings.

Stripped of the regulation blue and white, the complexes could be anything -- high-tech manufacturing plant, sports complex, deluxe offices.

As he puts it: "Architecture is an experience. I want to do something different. My main task is to convince others to agree with me.

"All architectural designs must not only be functional, the users must be proud of them as well.

"A building must evoke a positive emotion in its dwellers if it is a residence, and the employees if it is an office," he said.

While some architects apply feng shui in building designs, Razin incorporates Islamic elements.

His home in Kempas Baru, is built according to the concept of "paradise" as described in Ar-Ra'du 13:35 in the Quran.

"This verse talks about harmonious green and flowing water features. I incorporated these features into my designs," said the father of five.

Denai House, as it is named, is a double-storey bungalow sitting on slightly elevated terrain. The basement park, fitted with an elongated swimming pool, is much like a big, lush green carpet.

Staying there would not be unlike a dream vacation extended to last a lifetime.

The ground floor of the L-shaped building has a lounge surrounded by glass panels, a waiting area, as well as a small garden.

The top floor is all bedrooms, which are spread out like big balconies.

By the application of sliding door and pivoted timber screens, one can "switch on" the natural light and fresh air.

Razin has designed 25 bungalows.

A Pontian fisherman and his challenges

THE woes of fishermen in Pontian are unique, compared with those from other coastal towns. Due to the geography of the Pontian coast, the border that separates Malaysian waters with the waters off Indonesia makes our designated area of fishing very limited.

Fishermen with Class B boats, like myself, are only allowed to go as far as five nautical miles from the coast. We are only allowed to lay our nets as far north as Sungai Peneruk, which is about 50km.

Our limited fishing area has created a lot of problems for fishermen here who are already struggling with an infrequent catch and long hours.


Besides the border issue, fishermen risk being arrested by Indonesian authorities who patrol the waters. Not a month goes by without me hearing of fellow fishermen being detained or arrested in Indonesia for alleged encroachment.

Concerning this, I hope our Malaysian authorities, especially the Malaysian Maritime Enforcement Agency (MMEA), would step in to settle the problem.

I began as a fisherman five years ago, though I have been familiar with the work for as long as I could remember. My father is a fisherman, and among my two other siblings, I am the only one, besides my father, who has continued with the work.


I own four Class B boats, with four crewmen in each boat.

I used to work as a ship welder in Singapore. The company I worked for was based at a port and the work was difficult and stressful.

Travelling daily from Pontian to Singapore took a toll on me, and I quit the job after a year. That was when I decided to become a fisherman full time.


My current work has its ups and downs. The worst was probably when I was among the 500 fishermen affected when our subsidised diesel supply was recently cut for a week.

It happened when half of that group of fishermen who were based at the Goh Ah Heng jetty failed to settle their outstanding debts for payment on subsidised diesel.

Though I did not have any debts, the Pontian Area Fishermen's Association (PNK) stopped its supply of subsidised diesel to all of us. Many of my fellow fishermen then held a strike to demand for fairness.

Prices of fish soared by 40 per cent during that period as the supply of fish dwindled.

Fortunately, the strike and subsequent reports in the Press resulted in the Pontian PNK re-supplying us with diesel.

Working in the waters off Pontian is not like what it used to be 30 years ago. Back then, fishermen used small wooden boats with low-powered engines, or even those that sailed without engines.

Nowadays, fishing boats are large and are equipped with engines of up to 300 horsepower.

Naturally, we use much bigger nets now and each net requires us to go out to sea for at least five-and-a-half hours. Much of our work depends on the tide and currents, and that is why we sometimes need to go to sea at night.

As a Class B boat fisherman, my time is limited to 12 hours. It is common for fishermen to struggle with their earnings as our livelihood depends on the condition at sea.

That is why a cut of subsidised diesel had badly affected my fellow fishermen. Many people do not understand the life that we go through to put food on our family's table.

Nevertheless, whenever the going is good, fishermen are happy.

There is fortune to be made from the sea, if one is ready to put in hard work.

Pontian water is teeming with ikan bawal and tenggiri. Fish caught off Pontian have a good reputation among seafood lovers as they are fresh and taste good.

The unique taste is due to the seabed which is made up of mineral-rich earth.

It is a different seabed in Pontian and the rest of the west coast, as compared to the east coast of Johor, which mostly has sandy seabeds.

Ng Jih Chang, 33, is fisherman based at the Goh Ah Heng jetty in Pontian.
