FTSE Bursa Malaysia update: 9.30am

KUALA LUMPUR: At 9.30 a.m. today, there were 201 gainers, 99 losers and 246 counters traded unchanged on the Bursa Malaysia.

The FBM-KLCI was at 1,797.37 up 2.28 points, the FBMACE was at 5,364.50 up 11.47 points, and the FBMEmas was at 12,544.01 up 15.95 points.

Turnover was at 398.379 million shares valued at RM175.718 million. -- BERNAMA

Bursa extends gains at opening

KUALA LUMPUR: Stocks extended gains at opening today, riding on yesterday's bullish momentum, shored up by firmer regional markets amid hopes for further stimulus to stabilise the Chinese and Japanese economies, dealers said. At 9.05 am, the FTSE Bursa Malaysia KLCI (FBM KLCI) rose 5.02 points to 1,800.11, after opening 4.86 points higher at 1,799.95.

HwangDBS Vickers Research said riding on a two-day cumulative gain of 15.8 points or 0.9 per cent, the benchmark index appears technically ready to challenge the psychological barrier ahead.

"1,800 could be the resistance level that the FBM KLCI is targeting to breach next," it said in a note today.

The research house said providing a further boost to sentiments will be the positive vibe from external front whereas leading US equity indices rose between 0.2 per cent and 0.4 per cent aided by a better retail sales report.

On the scoreboard, the Plantation Index gained 5.641 points to 8,336.57, the Industrial Index rose 16.1 points to 3,050.32 and the Finance Index garnered 27.35 points to 17,097.79.

The FBM Emas Index firmed 30.881 points to 12,558.94, the FBM100 Index advanced 28.59 points to 12,284.56 and the FBM 70 Index gained 10.21 points to 14,441.01.

Gainers outpaced losers 136 to 36, with 137 counters unchanged, 1,264 untraded and 11 suspended.

Turnover totalled 141.48 million shares worth RM62.37 million.

Among actives, MAS added 1.5 sen to 33 sen, TH Heavy Engineering gained five sen to 93.5 sen and Astral Supreme earned one sen to 26.5 sen. Asia Media and Luster Industries were unchanged at 16 sen and 10.5 sen, respectively.

Heavyweights, CIMB added three sen to RM8.10, Axiata gained one sen to RM6.94, Sime Darby earned four sen to RM9.52 and Petronas Chemicals improved two sen to RM6.63. Maybank was unchanged at RM10.48. -- BERNAMA

Justice Department challenges American US Airways merger - USA TODAY

The Justice Department and several states have filed a lawsuit to halt the proposed merger of American Airlines and US Airways.

The airlines had anticipated merging within months to create the world's largest airline to compete against United and Delta airlines. But the lawsuit will hinder those plans.

The Justice Department filed the case in U.S. District Court for the District of Columbia with states of Arizona, Florida, Pennsylvania, Tennessee, Texas and the District of Columbia.

The lawsuit contends that the merger would hurt consumers.

"Because of the size of the airline industry, if this merger were approved, even a small increase in the price of airline tickets, checked bags, of flight change fees would cause hundreds of millions of dollars of harm to American consumers annually," the lawsuit says.

"Millions of passengers benefit each year from head-to-head competition that this merger would eliminate."

Spokesman for US Airways and American didn't immediately respond to requests for comment. But in defending the merger plans before congressional hearings, US Airways CEO Doug Parker, who would lead the new company, said few routes overlap between the carriers so that a merger wouldn't hurt competition.

The airlines sought to merge because of recent mergers of Southwest and AirTran, United and Continental and Delta and Northwest airlines. US Airways and American officials had been optimistic about their plans because the Justice Department approved each of those previous mergers.

But the Justice Department said US Airways Advantage Fares are significantly lower than American Airlines. For a trip from Miami to Cincinnati on Aug. 13 and returning Aug. 14, the US Airways Advantage Fare was $471 for one stop compared to $740 on a non-stop American flight, according to the Justice Department.

"By further reducing the number of legacy airlines and aligning the economic incentives of those that remain, the merger of US Airways and American would make it easier for the remaining airlines to cooperate rather than compete on price on service," the 56-page lawsuit said.

As examples of the benefits of competition, the Justice Department noted that US Airways tickets from Washington Reagan National Airport to Boston Logan Airport dropped significantly after the entry of JetBlue competition. Average US Airways tickets dropped from $366 in October 2010 to $236 in December 2010, or 36%, according to the Justice Department. The price of a walkup ticket dropped from $1,222 to $488, or 60%, according to the Justice Department.

Justice noted that the merged airline would control 69% of the slots at Reagan, which would be six times more than the closest competitor

"This would eliminate head to head competition at the airport between American and US Airways," the lawsuit said.

Juror says Bulger jury shouted about defense argument that government was on ... - Boston.com

A juror in the James J. "Whitey" Bulger trial says the defense argument that the government was also on trial resonated with jurors.

"It worked!" said Scott Hotyckey in an interview at his Framingham home. Jurors were "shouting about that" during deliberations, he said.

Hotyckey also said this morning that one of the biggest struggles in the jury room was over the murder of Debra Davis. He said some of the female jurors couldn't believe that Bulger would strangle the young woman.

The jury was unable to make a finding on whether Bulger murdered Debra Davis, who was the girlfriend of Bulger's crime partner, Stephen "The Rifleman" Flemmi. Flemmi testified that Bulger had murdered Davis, but jurors doubted Flemmi's credibility, Hotyckey told WBZ radio Monday.

Hotyckey also said many of the jurors on the four-man, eight-woman panel were terrified of the witnesses, many of them former associates of Bulger, who, among them, had pleaded guilty to dozens of murders.

Bulger was convicted Monday of 31 of 32 counts in a sweeping racketeering indictment. The jury in US District Court in Boston found that Bulger had committed 11 murders, but also found that prosecutors had not proven his involvement in seven others. The jury was unable to reach a verdict in the case of Davis.
